
Grand Auction terms & conditions
1. Participation in the auction is only open to individuals aged 18 and over (‘Bidder/s’).
2. By bidding for any lot, Bidders agree to be bound by these terms and conditions.
3. Bidders shall not knowingly allow any third party to bid on their behalf.
4. If a Bidder suspects that a bid has been entered on their behalf, they should contact Action for Children immediately.
5. Bidders must ensure they are able to bid for the particular lot in compliance with any applicable laws.
6. Bidders shall not be permitted to retract and bid under any circumstances after the bid has been submitted.
7. The decision of Action for Children shall be final and unchallengeable and in their absolute discretion they may declare any bid/entry void and not accepted.
8. Action for Children is not obligated to provide reason or explanation for any decision made.
9. Action for Children may authorize a representative to undertake any or all of their functions under these terms.
10. The Bidder with the highest bid accepted by the auctioneer/Action for Children or the Bidder announced as the highest Bidder following the conclusion of the auction, shall be the winning individual
11. The Bidder shall become liable to pay the amount of the bid or offer made on having been declared the winner Bidder by Action for Children.
12. The auction shall be conducted in pounds sterling.
13. Payment of the successful bid amount shall be made by the Bidder on the night using a credit or debit card, BACS payment or personal cheque made payable to Action for Children. By arrangement with Action for Children, the Bidder may pay by invoice within 30 days of the date of the auction.
14. All Bidders will be required to sign for their purchase at the event as proof of purchase (‘Bidder’s Proof of Purchase’).
15. The Bidder shall receive the signed Bidder’s Proof of Purchase and Action for Children shall retain a copy of the same.
16. Title of the lot will pass to the Bidder once full payment has been made.
17. The Bidder will assume responsibility for the lot upon payment including but not limited to any shipping or insurance cover.
18. Without prejudice to any rights that Action for Children may have, if the Bidder fails to make payment and Action for Children is not in full receipt of the full in respect of an auctioned item within 30 days of the auction, Action for Children may (at its discretion); store the auctioned item at the Bidder’s cost and risk; or, cancel the sale of the auctioned item and resell the auctioned item.
19. If items are not taken on the night by the Bidder, then all items must be collected within 2 months of the event date (‘the Relevant Period’). Any lots not collected within the Relevant Period shall revert to Action for Children without a right to a refund. Action for Children may (as its discretion) resell the lot.
20. For any items not taken home on the day of the event, the Bidder must cover costs of delivering the items at a later date.
